Terms of Service

These Terms of Service ("Terms") govern your use of the Capo mobile and web applications (together, the "Service") provided by CAPO SPORT LTD. By using Capo, you agree to these Terms. If you do not agree, please do not use the Service.

1. About Us

CAPO SPORT LTD (company number 17030048) operates the Capo platform.

2. Definitions

In these Terms:

  • "Service" means the Capo mobile and web applications, including all features for football statistics, score tracking, team management, bookings, and payments.
  • "Admin" means a user who creates and manages a team, league, or group within Capo, including setting match fees and managing players.
  • "Player" means a user who participates in matches organised through the Service.
  • "Team" or "League" means a group of players organised by an Admin within the Service.
  • "Content" means any information, text, images, statistics, or other materials uploaded, submitted, or generated through the Service.
  • "Fees" means any charges set by Admins for match participation, season passes, or other services within the platform.

3. Eligibility and Account Responsibilities

To use Capo, you must be at least 18 years old or have the consent of a parent or guardian.

You are responsible for:

  • Providing accurate information when creating your account
  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorised access

4. The Platform and Our Role

Capo provides a platform for organising football matches, tracking statistics, and facilitating payments between Admins and Players.

Important: Capo provides the technical infrastructure to facilitate payments and match organisation between Admins and Players. While we process payments and may assist in resolving disputes, the underlying match organisation and participation arrangements remain between the Admin and the Player.

Admins are solely responsible for:

  • Setting appropriate fees for their matches
  • Communicating match details, venue information, and any changes to players
  • Ensuring their activities comply with applicable laws and any club or league policies
  • Managing their team roster and player communications
  • Any disputes with players regarding match organisation (not payment processing)

5. Payments

a. Payment Processing

Payments are processed by Stripe, a third-party payment processor. By making or receiving payments through Capo, you also agree to Stripe's terms of service.

b. How Payments Work

Admins set the amount they wish to receive per player ("Admin Net Amount"). The Service calculates the total amount charged to players, which includes:

  • The Admin Net Amount (paid to the Admin)
  • Transaction fees (retained by Capo to cover platform and payment processing costs)

Admins receive exactly the amount they set. Transaction fees are bundled and not itemised to players.

c. Pay-to-Book Model

For paid matches, payment is required at booking time. Your spot is only confirmed when payment is successfully processed. No spot is held during checkout.

d. Season Passes

Admins may offer season passes that cover multiple matches within a specified date range. Pass terms (validity dates, included matches) are set by the Admin at the time of purchase.

Capo does not guarantee that a minimum number of matches will occur under any season pass. Match scheduling and delivery remain the responsibility of the Admin.

e. Refunds

Our refund policy is as follows:

  • Player cancellation: If you cancel your booking, a refund is issued immediately minus transaction fees. Your bank may take 5-10 business days to show the funds.
  • Match cancelled by Admin: Full refund issued. Transaction fees are not retained.
  • System error: Full refund issued if a booking fails due to a platform error.
  • Admin removes player: The Admin chooses the refund amount (standard refund minus fees, full refund, or no refund depending on circumstances).
  • Pass refunds: At the Admin's discretion. Standard refunds are minus transaction fees; full refunds may be issued at the Admin's choice.

Refunds are issued to the original payment method. Processing times depend on your bank.

Capo reserves the right to override an Admin's refund decision where required by law, Stripe's rules, or to prevent fraud or abuse.

f. Chargebacks and Disputes

If you believe a charge is incorrect, please contact us at hello@caposport.com before initiating a chargeback with your bank. We will investigate and respond promptly.

Chargebacks (disputes filed with your bank) are handled according to Stripe's dispute process. We may provide evidence to Stripe regarding the transaction. Excessive or fraudulent chargebacks may result in account suspension.

We reserve the right to recover chargeback fees and related administrative costs from the user responsible for the disputed transaction.

g. Taxes

Admins are responsible for any tax obligations arising from payments they receive through the Service. Capo does not provide tax advice. We recommend consulting a tax professional regarding your obligations.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Engage in fraud, including making false bookings or initiating fraudulent chargebacks
  • Harass, abuse, or threaten other users
  • Impersonate another person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorised access to any part of the Service
  • Use automated systems to access the Service without permission
  • Collect user information without consent
  • Post or transmit harmful content, including viruses or malicious code

7. Intellectual Property

The Capo platform, including its design, features, code, and branding, is owned by CAPO SPORT LTD. Capo® is a registered trademark.

You retain ownership of any Content you submit. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute that Content as necessary to operate the Service.

You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from these Terms or your use of the Service is limited to the greater of: (a) the amount paid by you through the Service in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

9. Force Majeure

We are not liable for any delay or failure to perform resulting from events outside our reasonable control, including but not limited to internet outages, payment processor failures, hosting provider issues, or governmental actions.

10. Termination and Suspension

We may suspend or terminate your account if:

  • You breach these Terms
  • We reasonably suspect fraudulent or abusive activity
  • Required by law or a valid legal request
  • Your account poses a risk to other users or the platform

You may close your account at any time by contacting us at hello@caposport.com.

Upon termination:

  • Your access to the Service will be revoked
  • Outstanding payment obligations remain due
  • We may retain certain data as required by law or as described in our Privacy Policy
  • Match history and statistics may be retained in anonymised form to preserve league integrity

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will be changed accordingly.

For significant changes, we will notify you via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales.

Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
